Terms of Service

1. About This Service

Example Community ("the Community Group") provides a Get Help / Give Help service ("the Service") for community coordination during disaster recovery. The Service combines this software platform with volunteer moderators to allow community members to submit needs and offers of assistance, and to help put people in contact with each other.

The software platform is developed and maintained by Off Duty Apps ("the Software Provider"). By using this Service, you agree to these Terms of Service.

2. What This Service Is (and Is Not)

This Service is a coordination tool. It allows community members to share what they need and what they can offer. Our volunteer moderators do their best to put the right people in contact with each other, but mistakes can happen and no outcome is guaranteed.

This Service is not:

  • An emergency service — if you are in an emergency, call 000.
  • A guarantee that any need will be fulfilled or any offer will be taken up.
  • A guarantee that anyone will be put in contact with anyone else.
  • A guarantee that every submission will be reviewed, matched, or acted upon.
  • A guarantee that any contact made between users will be appropriate, relevant, or for the right reason.
  • A professional advisory, medical, legal, or financial service.

All participation is voluntary. Submitting a need does not create an entitlement to receive assistance. Submitting an offer does not create an obligation to provide it.

3. Limitation of Liability

To the maximum extent permitted by Australian law, the following parties are not liable for any loss, damage, injury, or expense (whether direct, indirect, incidental, or consequential) arising from or in connection with the use of this Service:

3.1 The Software Provider (Off Duty Apps)

Off Duty Apps provides the software platform on an "as is" basis and is not liable for:

  • The accuracy, completeness, or reliability of any information submitted by users.
  • Any interruption, outage, data loss, or technical failure of the platform.
  • Any decisions made or actions taken by users, moderators, or the Community Group.
  • Any outcomes (or lack of outcomes) resulting from the use of the Service.

3.2 The Community Group (Example Community)

The Community Group coordinates the Service on a voluntary basis and is not liable for:

  • Any failure to connect people who have submitted needs with people who have submitted offers.
  • The quality, suitability, safety, or legality of any goods, services, or assistance offered or provided through the Service.
  • Any interactions, agreements, or disputes between users.
  • Any delay in reviewing or responding to submissions.

3.3 Moderators and Volunteers

Moderators and volunteers act in a voluntary capacity and are not liable for:

  • Any failure to connect a person in need with a person offering assistance.
  • Any decision about which submissions to prioritise, connect, or decline.
  • Any outcomes resulting from contact they facilitated between users.
  • Any delay or omission in reviewing or acting on submissions.

4. Interactions Between Users

If this Service puts you in contact with another person, any arrangement you make is between the two of you. The Community Group, its moderators, and Off Duty Apps are not a party to any agreement, transaction, or interaction between users.

While we aim to connect people appropriately, no party guarantees that any contact made between users will be appropriate, relevant, or suited to your circumstances. You are solely responsible for assessing the suitability of any assistance you choose to accept or provide, and for your own safety in any interaction.

5. Your Responsibilities

By using this Service, you agree that:

  • The information you submit is accurate and truthful to the best of your knowledge.
  • You will not submit false, misleading, offensive, or malicious content.
  • You are responsible for your own decisions regarding any assistance you offer or accept.
  • You will exercise your own judgement and take reasonable steps to ensure your own safety when interacting with other users.
  • You understand that the Service does not verify the identity, credentials, or claims of any user.

6. User Content

You retain ownership of any content you submit. By submitting content, you grant the Community Group a non-exclusive, royalty-free licence to use, display, and share that content for the purposes described in the Privacy Policy.

The Community Group and its moderators reserve the right to remove, edit, or decline to display any submission at their discretion, including content that is offensive, misleading, or inappropriate.

7. No Warranty

The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. No party warrants that the Service will be uninterrupted, error-free, or secure.

8. Indemnity

You agree to indemnify and hold harmless Off Duty Apps, the Community Group, and their respective moderators, volunteers, officers, and agents from any claims, liabilities, damages, losses, or expenses (including legal fees) arising out of your use of the Service, your submissions, or your breach of these Terms.

9. Governing Law

These Terms are governed by and construed in accordance with the laws of Australia. Any disputes arising under these Terms are subject to the exclusive jurisdiction of the courts of Australia.

10. Australian Consumer Law

Nothing in these Terms is intended to exclude, restrict, or modify any rights you may have under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or any other applicable consumer protection legislation that cannot be excluded by agreement.

11. Changes to These Terms

We may update these Terms from time to time. If we make changes, we will update this page. Your continued use of the Service after changes are posted constitutes your acceptance of the updated Terms.
